Calorie Detective: Cuby, an aair Labs product ("Cuby", "we", "us", or "our"), provides an AI-powered nutrition coaching, calorie tracking, and fitness companion mobile application (the "App"). We are committed to protecting your privacy and handling your data with transparency. This Privacy Policy explains what we collect, how we use it, and the choices you have. This Privacy Policy is incorporated into and subject to our Terms and Conditions, including their disclaimers and limitations of liability. aair Labs is the data controller responsible for your personal data and can be reached at contact.aairlabs@gmail.com.
1. Information We Collect
To provide our services, we collect the following types of information:
- Account Information: When you create an account with email and password or sign in with Google, we process your email address and account identifier to create and secure your account. Sign in with Apple is also available on iPhone. Depending on the sign-in method, we may receive your name.
- Personal Health & Profile Data: Age, gender, height, current weight, target weight, activity level, dietary preferences, your goals and target dates, and the responses you provide during onboarding, including the challenges, emotional-eating triggers, and coping strategies you select. This is used to calculate your personalized calorie and macro targets and to tailor your coaching plan.
- Food Logs & Media: Text descriptions, barcodes, and photos of food and meals you upload or scan. We use these to identify food items and estimate nutritional content.
- Apple Health Data (iPhone only): With your explicit permission, we read activity and nutrition metrics (such as steps and calories) and may write nutrition data (such as protein and calories) back to Apple Health. This data is used only to power your tracking and progress features and is never sold. The Android app does not currently connect to Health Connect or Google Fit.
- Voice & Audio Data: When you use voice coaching or speech features, we process your microphone input and speech transcriptions to power conversational interactions with the AI companion.
- Mood & Wellbeing Check-ins: If you complete a mood check-in, we collect how you rate your mood, the feelings and factors you select, and any optional notes. We use this to personalize coaching tips and suggested activities. This information is never sold.
- Approximate Location: Our analytics and attribution providers may infer an approximate region or city from your IP address for measurement and attribution. Cuby does not request your precise GPS location.
- Usage & Device Data: Information about how you interact with the App (features used, sessions, error logs) and device details (device model, OS version, and unique device identifiers) for support and analytics.
- Push Notification Tokens: If you enable notifications, we register your device's push token so we can send reminders and let you know when content (such as a new personalized audio recap) is ready.
- Advertising & Attribution Identifiers: To measure which marketing channels drive installs and subscriptions, we may process advertising and attribution identifiers, including the Android advertising ID and Apple IDFA/IDFV. On iOS, we only access the IDFA if you grant permission through the App Tracking Transparency prompt. Android advertising-ID controls are available in your device settings.
2. How We Use Your Information
We use your data to:
- Provide personalized nutrition coaching, calorie tracking, fasting, recipes, and lesson content.
- Analyze food photos, barcodes, and recipes using AI and computer vision models to estimate nutrition.
- Power the conversational AI coaching companion, including voice and text interactions.
- Sync and display your activity, nutrition, and progress data.
- Generate personalized tips and suggested activities from your mood and wellbeing check-ins.
- Generate personalized daily insights and audio recaps (the "Check-In Podcast") from your logs and check-ins.
- Send service-related notifications, reminders, and updates.
- Process and manage subscription entitlements.
- Improve our App and, where applicable, refine the accuracy of our models using de-identified or aggregated data.
3. AI and Automated Processing
Cuby uses artificial intelligence, including third-party AI providers, to analyze your inputs (food images, text, and voice) and generate coaching responses. While we strive for accuracy, AI predictions regarding calorie counts and nutritional information are estimates and should not be treated as verified medical or scientific data. Inputs sent to AI providers are used to generate your responses and are not sold. We do not use solely automated decision-making that produces legal or similarly significant effects concerning you.
4. Data Sharing and Disclosure
We do not sell your personal data. We may share data with:
- Service Providers: Trusted third parties who help us operate the App, including cloud hosting and database (Supabase), AI, voice, and text-to-speech providers (e.g., Google Gemini, ElevenLabs), food and nutrition databases (such as Edamam and Open Food Facts), push-notification delivery (Apple Push Notification service, Firebase Cloud Messaging), analytics and product measurement (Mixpanel, PostHog), crash and error monitoring (Sentry), mobile attribution (AppsFlyer), and subscription management (RevenueCat, Apple App Store, Google Play Store).
- Apple Health (iPhone only): Health data is exchanged with Apple Health only when you authorize it, under Apple's health data policies. We do not use Apple Health data for advertising. Android does not currently exchange data with Health Connect or Google Fit.
- Legal Requirements: If required by law, regulation, or valid legal process.
5. Data Retention and Deletion
We retain your data only for as long as your account is active or as needed to provide the Service. We may retain certain information for a longer period where required for legal, accounting, security, fraud-prevention, or dispute-resolution purposes, after which it is deleted or anonymized. You may request the deletion of your account and associated data at any time via the App settings or by contacting us at contact.aairlabs@gmail.com. You can also request deletion through our account-deletion page without signing in. Apple Health access can be revoked in your iPhone's health settings.
6. Data Security and Limitation of Liability
We use commercially reasonable safeguards, including encryption in transit (TLS/SSL) and access controls, to protect your data. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security. You use the Service and provide your data at your own risk. To the maximum extent permitted by law, we are not liable for any unauthorized access to, loss, or alteration of your data, and our liability is limited as set out in our Terms and Conditions.
7. International Data Transfers
We and our service providers may process and store your data in countries other than your own, including outside the European Economic Area (EEA) and the United Kingdom, which may have different data protection laws. Where we transfer personal data internationally, we rely on appropriate safeguards required by law, such as the European Commission's Standard Contractual Clauses (SCCs), the UK International Data Transfer Addendum, or an adequacy decision. You may request a copy of the relevant safeguards by contacting us.
8. Children's Privacy
Cuby is for adults aged 18 and older. Our Service is not intended for users under the age of 18. We do not knowingly collect personal information from people under 18. If we learn we have collected such information, we will delete it.
9. Legal Bases for Processing (EEA & UK)
If you are in the European Economic Area, the United Kingdom, or Switzerland, we process your personal data under one or more of the following legal bases:
- Performance of a contract: to create your account and provide the App and the features you request.
- Consent: for optional processing such as health and fitness data, push notifications, marketing and attribution identifiers, and the health-related and wellbeing information you choose to provide. You may withdraw your consent at any time, without affecting processing carried out before withdrawal.
- Legitimate interests: to secure, support, measure, analyze, and improve the App, where those interests are not overridden by your rights and freedoms.
- Legal obligation: to comply with applicable laws and respond to lawful requests.
Some of the data we process, including your weight, mood, emotional-eating, and other health and wellbeing information, is a "special category" of personal data. We process it only on the basis of your explicit consent, which you give by choosing to enter that information, and you may withdraw it at any time.
10. Your Privacy Rights and Choices
Depending on where you live (including under the EU and UK GDPR, and similar laws such as the CCPA/CPRA in California), you may have the right to: access the personal data we hold about you; correct inaccurate data; delete your data; restrict or object to certain processing; receive your data in a portable, machine-readable format; withdraw consent at any time; and not be discriminated against for exercising these rights. We do not sell your personal data.
To exercise any of these rights, contact us at contact.aairlabs@gmail.com or use the in-App account-deletion option. We will respond within the timeframes required by applicable law and may need to verify your identity first. If you are in the EEA or UK, you also have the right to lodge a complaint with your local data protection authority (in the UK, the Information Commissioner's Office (ICO)); we'd appreciate the chance to address your concerns first.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the "Last Updated" date above.
