Terms of Service

Welcome to asho. These Terms of Service ("Terms") are a binding agreement between you and aair Labs ("asho", "we", "us", or "our") and govern your use of the asho Go mobile app and the features offered through it (together, the "Services"). Please read them carefully. By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Acceptance of these terms

By accessing or using the Services, you confirm that you can form a binding contract with us and that you agree to these Terms and to our Privacy Policy. If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms for it.

2. Who can use asho

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Services. If you are under 18, you may use asho only with the involvement of a parent or guardian.

3. What asho does

asho is an AI virtual try-on and shopping assistant. You create a personal try-on model from a photo, browse clothing from third-party online stores, and see how items look on your model. You can build a wardrobe, save outfits, and revisit past try-ons. Features that generate images use credits or a subscription, as described below.

4. Your account

You are responsible for the accuracy of your account information and for keeping your login credentials secure. You are responsible for activity under your account. Tell us promptly at contact.aairlabs@gmail.com if you suspect unauthorized use. You may delete your account at any time from within the app.

5. Subscriptions, credits, and billing

• Credits. Generating models and try-on images consumes credits. Credits and subscription benefits have no cash value, are non-transferable, and are not redeemable for money except where required by law.
• Subscriptions. Paid subscriptions are billed through the Apple App Store or Google Play and managed through RevenueCat. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current term.
• Managing and cancelling. Manage or cancel your subscription through your Apple or Google account settings. Deleting the app does not cancel a subscription.
• Refunds. Payments are handled by the app stores, and refunds are subject to their policies. Except where required by law, purchases are non-refundable.
• Price changes. We may change prices and plans; changes apply to future billing periods and, where required, only after notice and your consent.

6. Your content and the license you give us

You keep ownership of the photos and content you upload ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, store, process, adapt, and display Your Content solely to operate and improve the Services, for example, to create your try-on model and generate try-on images. This license ends when you delete Your Content or your account, except for content already shared with service providers as needed to deliver the feature, or that we must retain by law.

You represent that you have the right to upload Your Content and that it does not infringe anyone's rights. Only upload photos of yourself or photos you have explicit permission to use. Do not upload photos of other people without their consent.

7. AI-generated content and try-on results

Try-on images and other AI outputs are computer-generated visualizations. They are provided to help you imagine a look and may not accurately reflect real-world fit, size, color, texture, or fabric. Do not rely on them as a guarantee of how a product will actually look, fit, or perform. Product names, prices, descriptions, and availability come from third-party retailers and may be inaccurate or out of date.

8. Shopping and third-party retailers

asho lets you browse and buy from third-party online stores. We are not the seller, and we do not control those stores. Any purchase you make is a transaction between you and the retailer, governed by that retailer's terms and policies. We are not responsible for products, prices, orders, shipping, returns, or the content or practices of third-party sites.

9. Acceptable use

You agree not to:

• upload unlawful, infringing, hateful, sexually explicit, or harmful content, or photos of others without consent;
• use the Services to harass, deceive, or harm others, or to create misleading imagery of real people;
• reverse engineer, scrape, overload, or interfere with the Services or their security;
• attempt to access accounts or data that are not yours; or
• use the Services in violation of any applicable law.

10. Intellectual property

The Services, including the asho name, logo, software, and design, are owned by aair Labs and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Services except as allowed by these Terms.

11. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that AI outputs will be accurate.

12. Limitation of liability

To the maximum extent permitted by law, aair Labs and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD 50.

13. Indemnification

You agree to indemnify and hold harmless aair Labs from claims, damages, and expenses arising out of your content, your use of the Services, or your violation of these Terms or the rights of others.

14. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Services or other users. Sections that by their nature should survive termination, including content licenses already granted, disclaimers, limitations of liability, and indemnification, will continue to apply.

15. Changes to the Services and these terms

We may update the Services and these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date and provide notice where required. Your continued use of the Services after changes take effect means you accept the revised Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts of Lagos State, Nigeria, unless applicable law gives you the right to bring proceedings elsewhere.

If you are a consumer resident in the European Economic Area or the United Kingdom, nothing in this section removes the protection of the mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the courts of that country.
